What is the DV Lottery and how does it work?

The Diversity Immigrant Visa Program (DV Lottery Program) is a U.S. immigration program that seeks to further diversify the population of the United States by granting Lawful Permanent Resident (LPR) status to applicants born in countries with historically low rates of U.S. immigration as well as to their eligible family members (i.e., legally married spouse and unmarried children under 21 years of age).

There are two major requirements to participate in the DV Lottery:

  1. The main applicant must have been born in a country that is eligible to participate in the DV Lottery.
  2. The main applicant must also satisfy either the education OR work experience criteria:
  • Education Criteria – The main applicant must have at least a high school education; OR
  • Work Experience Criteria – The main applicant must have a minimum of 2 years of work experience in the previous 5 years in an eligible occupation that requires at least 2 years of experience or training to perform.

In addition to meeting the two major eligibility requirements for the Diversity Visa Lottery Program, an applicant must correctly complete and file his or her DV Lottery application, including a color digital photo for the main applicant and each family member in the application, on the U.S. State Department’s E-DV website during the brief annual registration period which usually occurs in October.

It is very important that all of the information in the DV Lottery application is correct and that the photos are taken six months prior to the submission in accordance with the strict DV Lottery regulations, in order to avoid being disqualified after selection during the consular process, because of mistakes made on the application.

Approximately 100,000 DV Lottery participants are randomly selected by computer from six global regions for the opportunity to continue the process to apply for one of the 55,000 Diversity Immigrant Visas and Permanent Resident Green Cards made available through this U.S. immigration program each year.

Participants of the DV Lottery can check if they were randomly selected on the U.S. State Department’s E-DV website, usually starting in early May when the results are released.

After being randomly selected as a DV Lottery winner, the main applicant will need to file the Form DS-260 Immigrant Visa Electronic Application with the U.S. State Department’s Kentucky Consular Center (KCC), which schedules the consular interview.

If the main applicant and his or her family members complete the consular interview at the American Embassy or Consulate successfully, they will receive Diversity Immigrant Visas in their passport(s) and must enter the United States while their DVs are still valid.

The new immigrants will also need to pay the online Immigrant Fee to U.S. Citizenship and Immigration Services (USCIS) so the plastic United States Permanent Resident Card(s), commonly known as Green Cards, can be sent to their address in the USA.

Can you edit your DV Lottery application after submitting it?

You cannot edit your DV Lottery Application after submitting it.

Can you resubmit the DV Lottery application?

You cannot resubmit the DV Lottery application once it has been submitted successfully.

According to the official instructions for the Diversity Immigrant Visa Program, an individual can only submit one DV Lottery application under his or her name in any particular year.

If you submit more than one DV Lottery application under your name in any given year, you will be disqualified.

You can, however, submit a new DV Lottery application during the next registration period the following year if you still satisfy the eligibility requirements at that time.

What happens if you make a mistake on the DV Lottery application?

You can edit your application and correct any mistakes before you submit it to the DV Lottery, however, you must complete your entire application and upload the photo(s) during one online session.

After you submit your application to the DV Lottery, you cannot edit your application.

If you make a mistake on the DV Lottery application and submit it successfully, you may still be able to participate in the DV Lottery, however, you could be disqualified during the consular process if you are randomly selected as a winner.

Whether or not you are disqualified for making a mistake on your DV Lottery application will depend on what the mistake was and the decision made by the particular consular official who handles your case.

If you fail to enter your spouse or dependent child on your DV Lottery application, this will usually result in being disqualified (unless they are already a U.S. citizen or Lawful Permanent Resident).

Additionally, if you enter false information on your DV Lottery application, you will also be disqualified (for example, if you indicated that you were born in an eligible country, when you were actually born in an ineligible country).

You can only apply once for the annual DV Lottery under your name in any particular year. If you submit more than one DV Lottery application under your name in a particular year, you will be disqualified. You can, however, submit one DV Lottery application under your name per year, year-after-year, as long as you still satisfy the eligibility requirements. For example, a person usually has to participate in the DV Lottery more than one year before he or she is randomly selected as a winner.  

If you apply twice for a Green Card under your name in the same year through the DV Lottery, you will be disqualified. In the event that you are legally married and both you and your spouse are eligible to submit separate DV Lottery applications, it is permitted for you to submit a DV Lottery application under your name and for your spouse to submit a separate DV Lottery application under his or her name. Each DV Lottery application would need to include details and photos of the main applicant, the other spouse and all dependent unmarried children under 21 years of age. If your DV Lottery application or your spouse’s DV Lottery application is randomly selected, then the entire family gets to continue the U.S. immigration process to apply for a Green Card!

Unfortunately, you cannot correct a mistake on the DV Lottery application after submitting it, so it is very important to complete your application carefully and correctly and to upload the photo(s) according to the DV Lottery regulations.

A person can apply for the DV Lottery once per year for as many years as desired, as long as he or she satisfies the eligibility requirements. In fact, an individual usually needs to participate in the DV Lottery more than one year before being randomly selected as a winner and given the opportunity to continue the process to apply for a U.S. Permanent Resident Green Card.

If you are randomly selected as a winner of the DV Lottery, the U.S. State Department will NOT send you an email informing you that you were selected. Although the numbers vary from year to year, approximately 10-12 million main applicants participate in the DV Lottery each year, along with their dependent family members, and around 100,000 winners are randomly selected by computer from six global regions for the opportunity to apply for one of the 55,000 U.S. Diversity Immigrant Visas and Permanent Resident Green Cards that are authorized to be issued annually through this U.S. immigration program.

If you need to reschedule your Diversity Visa consular interview, you should contact the American Embassy or Consulate where your interview is scheduled as soon as possible to schedule the interview on another date. Keep in mind, however, that all of the Diversity Immigrant Visas must be issued no later than September 30th of the fiscal year and there are a limited number of Diversity Immigrant Visas that can be issued for various countries and global regions. Thus, it is best not to reschedule a consular interview if it is not absolutely necessary, because the delay might result in losing the opportunity to immigrate to the United States.

According to the U.S. State Department, it is permissible to use a feature on a digital camera to reduce or prevent red eye, however, “you are not allowed to digitally enhance or alter the photo to change your appearance in any way.”
